The brief
A substantial parcel in the Keysborough South Local Planning Policy Area required transition from rural to urban residential use under the Greater Dandenong Planning Scheme. The strategic task was two-fold: a Planning Scheme Amendment that both rezoned the land and introduced a Development Plan Overlay to govern its staged development, and the Development Plan itself — addressing Clause 56.03 and 56.06 obligations, urban design, neighbourhood activity centre framework, traffic, heritage, flora and fauna, biodiversity, environmental and stormwater management, staging, public open-space equalisation across multiple landowners, and a primary-school site. Council's adopted 'green vision' required the public realm — linked open-space corridors, wetlands and flora/fauna habitat — to lead the design.
How we handled it
Frank Perry represented multiple landowners across the Development Plan area through the Amendment C36 process — including written and oral submissions to the Independent Planning Panel. After the amendment and Development Plan Overlay Schedule 5 were adopted, Frank prepared the Development Plan for Stages 2 and 3 of the Keysborough South area as a single coordinated document giving direction to the subsequent subdivision of all landholdings in the Plan area.
The result
Amendment C36 to the Greater Dandenong Planning Scheme was gazetted — rezoning the land and introducing Development Plan Overlay Schedule 5. The Development Plan for Stages 2 and 3 was adopted in 2008, providing the coordinated planning framework that enabled the subsequent subdivision and delivery of multiple residential estates across the precinct.
