What does a VCAT planning appeal actually cost?

Nobody publishes their fees for VCAT planning reviews — so the most common question we're asked has no answer you can Google. Here is the honest breakdown: tribunal fees, professional costs, the traps, and the two fixed prices we publish.

Search "VCAT appeal cost" and you will find process guides, council fact sheets and consultants inviting you to call for a quote. What you will not find is a number. For a person staring at a refusal notice — or at a neighbour's approval they believe is wrong — that silence is its own kind of cost: you cannot weigh a fight you cannot price.

This article sets out the real components, with the honesty the subject deserves. And because we think the quote-first convention serves firms better than clients, it ends with the two fixed prices we publish.

First, the clock — because it prices everything else

Costs only matter if you are in time:

  • Permit applicants seeking review of a refusal, or of conditions, generally have 60 days from the decision.
  • Objectors seeking review of a council's decision to grant a permit (a section 82 review) generally have 28 days from the notice of decision.

The date on your notice governs, and extensions are a tribunal discretion never to be assumed. Every week spent deciding whether to get advice is a week your advisers don't have.

The cost components

1. VCAT's own fees. The tribunal charges a fee to lodge an application for review, scaled by the nature of the matter, and daily hearing fees can apply in some lists and case types. These are set by regulation, change periodically, and are published on VCAT's fee schedule — budget several hundred dollars for lodgement in a typical planning matter and check the current schedule rather than any blog post, including this one. Fee relief exists for eligible applicants.

2. Professional costs — the number nobody publishes. This is where matters diverge. A straightforward review run by a town planner — grounds, submissions, a hearing appearance — is a different animal from a multi-day contested hearing with a barrister, expert witnesses on traffic, arboriculture and urban design, and weeks of preparation. As a general observation from decades in this jurisdiction: a fully contested matter with legal representation and experts runs well into five figures, and complex matters much further. That is precisely why the first question — is this fight worth having? — deserves a professional answer before the serious money, not after.

3. The costs you usually keep either way. VCAT's general practice in planning matters is that each party bears its own costs, win or lose. Cost awards exist but are exceptional. Budget on the basis that what you spend is yours to spend — which cuts both ways: an objector group pooling funds faces the same arithmetic as the developer.

4. The hidden component: holding costs. For applicants, the months a review takes have their own price — finance, rent, escalation. Sometimes a redesign and fresh application beats a technically winnable appeal on time alone. An honest adviser tells you so.

The trap on both sides

Applicants over-commit to weak appeals because nobody priced an honest prospects assessment — the first professional they called quoted the whole war. Objectors under-commit to strong reviews because the 28-day window closes while they are still ringing around for quotes. Both failures trace to the same cause: the absence of a published, fixed, entry-level price for a professional answer.

What we charge — published, fixed

We publish our prices because we think you should be able to make this decision the way you make any other:

  • Council Decision Review & Appeal Prospects — $990 inc. GST. A practising town planner reads the decision, the officer's report and your plans, checks comparable tribunal outcomes, and gives you a plain verdict: your prospects, the reasons, and the recommended path — appeal, amend and re-apply, negotiate, or stop. Delivered within three business days. If the honest answer is "don't appeal", you will have bought exactly that answer, with the alternatives mapped.

  • VCAT Application Pack — $2,490 inc. GST. Your application for review prepared and lodged, the statement of grounds drafted and signed by our planner, and a procedural roadmap for what follows. For applicants and for objectors — including grounds framed to survive the deemed-to-comply arguments developers increasingly run against objector reviews. The $990 assessment is credited in full if you proceed. Hearing representation, if your matter runs that far, is a separate engagement we quote once the issues are defined — many matters resolve at mediation or compulsory conference first.

Both are ordered online with your documents uploaded at the time of purchase, and the work starts when payment is made — built for people on a deadline, which in this jurisdiction is everyone.

Perry Town Planning (F. R. Perry & Associates Pty Ltd) has practised town planning across Victoria since 1999 and appears at VCAT for applicants and objectors. Review windows stated are the general statutory periods; the date on your notice governs.
